General Policy
We reserve the right to make changes to our site, policies, and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
You agree that the laws of the State of Victoria, Australia will apply to all transactions and communications on this site, and you submit to the jurisdiction of the courts of Victoria to hear any dispute.
These terms constitute the entire agreement between you and mydigitalphotos regarding the operation of the site.
Notices to ourselves can be sent to 688 Glenferrie Road, Hawthorn Vic 3122. You acknowledge that we may use your primary email to us as your address for any alterations to this policy and you agree to such communications.
Established members will occasionally receive information on products, services, special deals, and a newsletter. Out of respect for the privacy of our users we present the option to not receive these types of communications.
If you no longer wish to receive our newsletter or promotional materials you may request that we no longer send you these communications.
Privacy policy & data security
By using our Mydigitalphotos web site, you consent to the collection and use of this information by Mydigitalphotos. We use the information we collect about you to process your purchases and to assist us in offering services and products to you.
No credit card number is stored in the system. Your credit card details are deleted for our system as soon as the goods have been collected or sent to you.
Your personal information is protected both online and off-line. We use SSL encryption to protect information online, to learn more about SSL, follow this link http://wp.netscape.com/eng/ssl3/. All our employees are kept up-to-date on our security and privacy practices. The servers we use to store personally identifiable information are kept in a secure environment behind a locked cage in a 24/7 manned data centre.
Mydigitalphotos is covered by the 10 National Privacy Principles, as set out in the Privacy Act 1988 and is committed to protecting your privacy. We will not disclose any of your personal information to any other party without your consent in accordance with the Privacy Act 1998 (“the Act”) amended by the Privacy Amendment (Private Sector) Act 2000).
Your Order
Sending your photos over the web
Images must be in either Jpeg, bitmap and tiff format. Upload time will depend on the size of bandwidth you use for your Internet connection. You may find that larger resolution files may take longer to upload to our server.
Most digital picture quality issues are the result of printing low-resolution images. You can avoid poor print quality by setting your camera onto the highest resolution using the camera’s main menu. Higher resolution images will always give you better printed images whereas low-resolution images can result in colour shift, image graininess and sometimes colour casting of particular colours. It is very difficult and often impossible to correct low-resolution images before printing. We suggest that your images need to have a minimum resolution of 1000x1500 for a standard 10x15 cm (4”x6”) print and larger resolution sizes for enlargements. See our ‘Photo Tips’ section for more clarification on resolution.
Order Confirmation
We will confirm your order by email shortly after it is placed. We will then send your order to be printed and either held for you to pick up or dispatched by post. Your photos will be processed within 24 hours from receipt of your order unless you request otherwise. Your order will only be processed once payment has been made. Payment can only be made by Visa or MasterCard.
Although we send all orders either the same day or next day after they are printed some orders may take longer to arrive if sent by Australia Post depending on where they are posted to. If for some reason the printing of your order is likely to be delayed we will ring you to inform you of the delay and give you an estimated time of completion.
Mydigitalphotos deletes all photographic image files sent to us electronically within 7 working days or earlier unless you specifically request otherwise. If you request pickup from store or your photos are returned and we are unable to contact you your prepaid printed photos will be held in storage for a maximum period of 6 months. After this time they will be destroyed. No refunds will be available for printed material left for longer than 6 months.
All orders placed are subject to confirmation and acceptance by Mydigitalphotos. Pricing is in Australian dollars and is inclusive of GST.
To purchase from us over the Internet you must be over 18 years old.
Collection or Delivery of Order
Your Photos will be posted within 24 hours from the time we receive your order using Australia Post or courier. Please allow at least another 24 hours for delivery.
Where you request that we send products by mail we use registered mail. Mydigitalphotos will not send products to PO Boxes or to a third party address unless you have provided a valid reason why we should do so.
Because the freight cost varies depending upon the delivery location Mydigitalphotos reserves the right to adjust freight cost at any time. If you are sent any incorrect, damaged or missing items you must report any discrepancy to Mydigitalphotos within 24 hours of receipt by either phone, fax or email.
Cancellations & Refunds
If you wish to cancel an order you must do so immediately by phone, fax or email during business hours and receive confirmation of your cancellation from Mydigitalphotos. Cancellations that are attempted after the printing of your product will result in you still having to pay the printing costs. If the products have already by sent to you then you will also be responsible for the shipping and handling charges of your product. Mydigitalphotos will not refund you for already printed orders.
Returns of other products will only be accepted if these products are returned to us within 7 days of receipt. These goods must be in original condition and include all original packaging so that these items can be on sold. The cost of shipping and handling are not refundable. Mydigitalphotos will only raise a credit available for exchange on other goods or services provided by Mydigitalphotos. You must pay the postage of any returns.
Membership
As member of Mydigitalphotos you must provide us with complete and accurate information about yourself at all times. You remain responsible for your account at all times. Your obligation as a member includes all use of your account including confidentiality and all use of you’re your membership number.
Mydigitalphotos reserves the right to terminate your account if it is found to contain incomplete, false or inaccurate information.
Copyright
Mydigitalphotos will not knowingly print copyright images without the consent of the copyright owner. Mydigitalphotos attempts to comply with all Australian copyright legislation. It is important that you ensure that any images that you send to us for printing do not infringe copyright laws. If you are unsure you can contact http://www.copyright.org.au for more information.
